Refund Policy

This Refund Policy applies to all purchases made on the TheGift e-commerce platform, a software product of Digi Assets (Private) Limited. It is formulated in compliance with the Consumer Affairs Authority Act No. 9 of 2003, the Electronic Transactions Act No. 19 of 2006, and the Sale of Goods Ordinance (Chapter 391) of Sri Lanka.

Gift Vouchers & Point Top-Ups Are Non-Refundable

All gift voucher purchases on the TheGift platform are strictly non-refundable once the transaction is successfully completed and the voucher is issued. This policy applies to all face values, all customisation packages, and all purchasers without exception. By completing a purchase, you confirm that you have read and accepted this non-refundable policy.

The same applies to your loyalty point balance: once a point top-up payment is successfully completed and the points are credited to your account, that top-up is strictly non-refundable, regardless of whether the points are later used, unused, or still sitting in your points balance.

Voucher Validity & Expiry

All TheGift gift vouchers are valid for 12 months from the date of issue. The exact expiry date is displayed on the voucher and in your account dashboard. It is your responsibility to redeem the voucher before the expiry date.

Expired vouchers cannot be redeemed, extended, reinstated, or refunded under any circumstances. Once a voucher's validity period has lapsed, it is permanently void. No exceptions will be made regardless of the reason for non-redemption.

This is consistent with the position under Sri Lankan contract law and the Consumer Affairs Authority Act No. 9 of 2003, which permits non-refundability of pre-paid digital instruments when the validity period and non-refund policy are clearly disclosed prior to purchase, as they are on TheGift. Purchasers and recipients are advised to redeem vouchers well in advance of the expiry date.

Legal Basis Under Sri Lankan Law

Consumer Affairs Authority Act No. 9 of 2003: Under this Act, traders are not mandated to provide refunds for change of mind or personal preference. A non-refundable policy for pre-paid digital vouchers is permissible provided it is clearly communicated before the point of sale. TheGift displays this policy prominently on every checkout page.

Electronic Transactions Act No. 19 of 2006: Digital gift vouchers are electronic contracts. Under this Act, once an electronic transaction is completed, the parties are bound by the terms agreed upon at the time of contracting. The non-refundability of the voucher forms part of those agreed terms.

Sale of Goods Ordinance (Chapter 391): Gift vouchers are contractual instruments. Once issued and accepted, the contract of sale is complete. The Ordinance does not impose an obligation on sellers to accept returns of validly issued, non-defective pre-paid vouchers.

Payment and Settlement Systems Act No. 28 of 2005: All payment disputes relating to the payment processing stage (not the voucher itself) should be raised with our IPG partner and your card-issuing bank through the standard chargeback process, not with TheGift.

Merchant Product & Service Disputes

Once you redeem a TheGift voucher at a participating merchant, any dispute, complaint, or refund request arising from that merchant's goods or services is a matter between you and the merchant, not TheGift.

TheGift is solely responsible for the voucher purchase process, from the point you initiate checkout on our platform to the successful delivery and redemption of the voucher code. Our liability ends at the point the voucher is successfully redeemed.

Issues regarding a merchant's product quality, service delivery, non-performance, or any post-redemption experience must be raised directly with the relevant merchant. TheGift accepts no liability for the quality, suitability, availability, or non-delivery of any goods or services provided by participating merchants after voucher redemption.

If a merchant closes or becomes unable to fulfil a voucher redemption, please contact us at support@thegift.lk. We will make reasonable efforts to assist, but we cannot guarantee a remedy where the failure originates entirely from the merchant's side.

What TheGift Is Responsible For

TheGift is responsible for any issues that occur within the following scope:

Payment processing errors resulting in a charge without voucher issuance
Duplicate charges for the same order
Technical failures on our platform that prevent successful voucher delivery
Incorrect voucher values delivered due to a platform error
Voucher redemption failures caused by our platform (not the merchant)

To report any of the above, email support@thegift.lk with your order reference, a description of the issue, and any supporting screenshots. We will investigate and respond within 3 business days.

Governing Law & Contact

This Refund Policy is governed by the laws of the Democratic Socialist Republic of Sri Lanka. Disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
